Introduction and acceptance

Welcome to the Anoumabo Urban Music Festival (FEMUA) website located at http://www.femua.com/ (the “Site”), which includes all current and future sub-domains.

We hope you enjoy your visit and / or your use of the Services. By visiting the Site and / or using the Services, you agree to be bound by the terms of this Privacy Policy (the “Policy”).

The last modification of the Policy was made on January 18, 2020. FEMUA reserves the right, at any time and without notice, to modify or replace part of the Policy. Any changes to the Policy can be found at this URL. It is your responsibility to regularly check for changes to the Policy. Your use of the Services after the publication of changes to the Policy constitutes acceptance of these changes.

The Policy should be read in conjunction with the Terms of Use, since these two documents govern your use of the Services. When you use the Ticket System through the Services, you are also bound by the Ticket Purchase Agreement.

General statement of privacy and protection of personal information

The FEMUA Office of the General Commissioner takes the confidentiality and security of personal information very seriously. We have provided a secure environment and this Strict Policy which describes the limited means in which information is used and the limited access to such information.

What does this privacy policy cover?

This Policy covers the processing of personally identifiable information (“Personal Information”) and other information collected by the FEMUA General Commissioner when you use or access the Services. This Policy also covers the processing of Personal Information that FEMUA may share with its business partners or other third parties in very limited circumstances.

This Policy does not apply to general practices and the processing of information by third parties not owned and not controlled by FEMUA, including, but not limited to third party sites or services which you choose to access via Services (“Third Party Services”), or to persons who are not managed or employed by FEMUA. While we strive to facilitate access only to Third Party Services that share our respect for your privacy, we cannot assume responsibility for the content or privacy policies of such Third Party Services. We encourage you to carefully read the privacy policies of any Third Party Services you access.

Finally, this Policy does not cover Personal Information that you send to FEMUA via any unsecured communication mode such as email, instant messaging or Twitter, since communications via these methods may be subject to interception , loss or alteration. We encourage you to carefully review the Personal Information you send to FEMUA through these methods.

No collection of personal information

FEMUA does not collect all of your Personal Information automatically when you use the Services, unless you are asked to provide such information, for example by subscribing to the mailing list. Where you have provided such information, it will only be used for the purpose indicated.

Personal Information may be entered into the Site when you wish to connect to a third party service integrated into the website, such as Facebook or Twitter (the “Integrated Third Party Services”), but this information is in no way collected or stored by FEMUA, and they are used only for the stated purpose, in particular to connect to the Integrated Third Party Service.

Information security

We only use industry best practices in keeping the data collected secure. This includes HTTPS / SSL / TLS (Secure Socket Layer) for all ticket purchase transactions and for authentication and data transfer to Integrated Third Party Services. In addition, Osheaga uses third-party providers and hosting partners to provide the hardware, software, networks, storage and related technology necessary to perform the Services, and these providers have been selected in accordance with their standards safety standards.

Limited information collection for statistical and security purposes

FEMUA automatically collects certain information through third-party analysis software, Google Analytics, to help us understand how our users use the Services, but none of this information can identify you personally. For example, each time you visit the Site or use the Services, we automatically collect your IP address, browser and computer type, access time, the web page where you came from, and the page (s) ( s) web to which you are accessing (if applicable). We only use this information to better understand your needs and the needs of Service users as a whole. FEMUA also uses information collected for statistical purposes to track the number of visits to the Site and specific pages on the Site in order to make improvements.

Your IP address and other relevant information may be used to trace any fraudulent or criminal activity, or any activity in violation of the Terms of Use.

Non-disclosure of personal information to third parties


Except as provided in the following paragraphs, FEMUA does not disclose Personal Information collected via Third Party Services. In addition, FEMUA does not sell any information relating to its users to third parties. Only FEMUA employees, representatives, subcontractors or agents are responsible for the management and development of the Services, and only these people have access to the information collected there. These employees, representatives, subcontractors or agents have all been responsible for complying with the Policy.

Notwithstanding anything to the contrary in this Policy, we may share information that we have collected about you or that you have submitted: (1) in response to quotes, court orders, or the legal process, or to create, protect , or exercise our legal rights or defend against legal claims or requests; (2) if we deem it necessary to investigate, prevent or take action regarding illegal activities, fraud, or situations involving potential threats to the security of any person; (3) if we deem it necessary to investigate, prevent or take action regarding situations involving abuse of the Services infrastructure or the Internet in general (such as large spam, attacks by denial of service, or attempts to compromise the security of the infrastructure of the Site or the Services in general); (4) a parent company, subsidiaries, joint ventures or other companies under common control with FEMUA (in this case, such entities will be required to comply with this Policy); (5) if FEMUA is acquired by or merged with another entity (in which case, such entity will be required to assume our obligations under this Policy, or to notify you that you are covered by a new policy for confidentiality); (6) when you expressly consent to the provision of such information to third parties, such as our business partners, when the information will only be used for the purposes indicated.

In addition, FEMUA uses certain Integrated Third Party Services to augment the Services. Personal Information is transferred from FEMUA to the operators of these Integrated Third Party Services, but only to the extent necessary for it to function properly, and only upon your express submission of such information.

Finally, FEMUA can transfer your email address to Facebook, but only for the purpose of creating a Facebook Custom Audience (a personalized Facebook audience), in order to broadcast advertisements on Facebook that may be of interest to you. Please see the “Announcements” section later in this Policy for more information.

Removal from the mailing list and deletion of personal information


You can unsubscribe from the FEMUA mailing list at any time, by following the link at the bottom of all FEMUA emails. Note that unsubscribing from the mailing list in this way may not necessarily delete all of your Personal Information from the FEMUA databases. If you want to ensure that all Personal Information is deleted from our databases, please contact us.

Tracking technology (“cookies”)


FEMUA uses tracking technology (“cookies”) on the Site, and by using the Services, you agree to use them. Cookies are small text files placed on your hard drive when you visit a website, in order to track site usage and improve the user experience by storing certain data on your computer. The Site uses “session cookies”, which improve your user experience by storing certain information about your current visit on your computer.

Your browser can be configured to refuse cookies or delete them after they have been stored. Please note that deleting or refusing these cookies may reduce your user experience for the Services by asking you to re-enter certain information, such as regional preference. In addition, most session cookies used by FEMUA will expire after a short period of time or when you close your browsing session.

The Ticketing System uses certain session cookies such as the location of the waiting room, the event requested, and the number of requests, but none of these cookies can identify you personally. Please note that deleting or refusing these session cookies may hinder your ability to purchase tickets properly through the Ticket System, and Osheaga assumes no responsibility for any damages, material or moral, resulting from your inability to purchase tickets if you delete or refuse such cookies.

In addition to FEMUA session cookies on the Site and the Ticketing System, the Site also uses cookies from third parties, including Doubleclick (a subsidiary of Google, for serving ads on the Site), and AddThis (for sharing content via social media). There are also cookies used by YouTube, Facebook and Twitter for various widgets and content integration. The use of these third-party cookies is governed by their respective owners and FEMUA has no control over them and declines any responsibility for their use. These cookies can be refused or deleted by your browser at any time, even if their deletion can reduce or inhibit the use of certain third-party features integrated into the Services.

Advertisement


FEMUA currently uses Google AdWords and by using the Services you consent to this use. More specifically, FEMUA uses the remarketing features of interest-based advertising from Google AdWords which offers you ads that are of particular interest to you, based on your browsing history on the Site. These advertisements will appear on third party websites on the web. Google uses specific cookies to allow them to serve those ads on the web that are of particular interest to you.

You can avoid this type of advertising by deleting the appropriate Google cookie through your browser, but this may not be permanent. For a more permanent solution, you can unsubscribe from this Google ad at any time by visiting your Google Ad Settings page.

FEMUA can use your email address when creating a personalized Facebook Audience. We may submit your email address to Facebook to determine if you are a registered Facebook user and if so, to display advertisements for you on Facebook that are of particular interest to you. Facebook will not share this information with third parties, will maintain the strict confidentiality of the Personal Audience, and will immediately delete the data once it is determined whether or not you are a registered Facebook user. If you do not wish to receive such Facebook advertisements, please contact us.

FEMUA reserves the right to use additional retargeting or other advertising services in the future. In such a case, FEMUA will update this section of the Policy with more details.

Risks associated with the internet

Despite FEMUA’s efforts to ensure that a third party does not view or obtain your Personal Information through your use of the Services, complete privacy and security cannot be guaranteed at present on the Internet. Communications via the Internet are subject to interception, loss or alteration. You acknowledge and agree that FEMUA cannot be held liable for damages resulting from the transmission of confidential information or personal information over the Internet and that such communications are at your own risk.

Limitation of Liability

FEMUA and / or its officers, administrators, owners, agents, partners, partnerships, directors, employees, affiliates and other related entities, agents, agents, representatives, successors and respective assignees, will not be held liable for any damage resulting from the improper use of any information collected by the Services of third parties or by any third party, or any improper use of the information collected through the Site not in violation of the Policy.
